Bu çalışma 12 Eylül darbesiyle başa geçen ordunun yönetimde bulunduğu süre zarfında çıkartmış olduğu kanunlar ve Anayasa ile toplumu nasıl şekillendirmek istediği sorusuna cevap aramaktadır.Çalışmanın birinci bölümünde bir ülkede orduyu müdahale için harekete geçiren sebepler çeşitli faktörler altında ve örnek ülkeler eşliğinde incelenmiştir. İkinci bölümde Türkiye tarihinde, Osmanlı döneminden 12 Mart Muhtırası'na kadar olan süreçteki ordu-siyaset ilişkisi ele alınmakta, böylelikle ordunun Türkiye'de ne derece etkili olduğu tarihsel olarak anlatılmıştır. Bu bölümde ikinci el kaynaklar mümkün olduğunca zengin tutulmaya çalışılmıştır. Son bölümde ise 12 Eylül dönemi ile beraber Milli Güvenlik Konseyi'nin kabul ettiği kanunlar çalışmanın amacına yönelik incelenmiştir. Kanunlar incelenirken dönemin resmi gazeteleri birincil kaynağı oluşturmaktadır. Sonuç bölümünde ise incelenen kanunların genel bir değerlendirilmesi yer almaktadır.
This study looks for an answer the question that how the military -seized with 1980 coup d?etat- wanted to formalize the society with the laws and the constitution during his time in power.In the first chapter, the reasons for the military intervention in a country are investigated under for various factors and with the sample countries. In the second chapter, the relationship between military and politics from Ottoman Empire period to memorandum of 12th March is examined in Turkish history, thus how the military is effective in Turkey is explained historically. In this chapter, second hand sources are used as much as possible. In the last chapter, the legislated by National Security Council are researched for the purpose of the study. Official journal is the primary source for analysing the laws. In the conclusion, overall evaluation takes part about the investigated laws.
