1982 Anayasası'nda Türkiye Cumhuriyeti'nin hukuk devleti olduğu ifade edilmektedir. Ancak, her ne kadar 1982 Anayasası'nda Türkiye Cumhuriyeti'nin bir hukuk devleti olduğu belirtiliyor ise de; bu tez ile hukuk devleti ilkesinin yasal düzenlemeler ve uygulamalar ile ne kadar sağlanıp sağlanmadığı, özellikle idarenin işlemleri bağlamında araştırılması amaçlanmıştır. Bu amaç ile öncelikle hukuk devleti ilkesi genel ve özel gerekleri, devamında idarenin düzenleyici ve birel işlemlerinin özellikleri açıklanmaya çalışılmıştır. 1982 Anayasası'nda idarenin bütün işlem ve eylemlerinin yargı denetimine tabi olduğu kuralına yer verilmiş, Anayasa'nın bu kuralına rağmen, 1982 Anayasası'nın bazı hükümleri ve bazı yasal düzenlemeler ile idarenin bir kısım işlemleri yargı denetimi dışında tutulmuştur. Gerek düzenleyici, gerekse birel işlem niteliğinde olup da yargı denetimi dışında bırakılan bu işlemlerin, hukuk devleti ilkesi ve idarenin bütün işlem ve eylemlerinin yargı denetimine tabidir kuralı karşısındaki durumlarının ne olduğu, hukuk devleti ilkesi ile ne ölçüde bağdaşıp bağdaşmadığının irdelenmesi büyük önem taşımaktadır. Bu amaçla yapılan bu tezde yargı denetimi dışında bırakılan işlemlerin tek tek incelenmesi ve hukuk devleti ilkesinin gereklerinin tamamen ortaya konması ve özellikle Anayasa Mahkemesi ve Danıştay kararlarının incelenmesi sonucunda; idarenin bazı işlemlerinin yargı denetimi dışında tutulmasının; idarenin hukuka bağlılığı ve işlemlerinin yargı denetimine tabi olması gibi hukuk devleti ilkesinin en temel prensiplerine uymadığı sonucuna ulaşılmıştır.
It was stated in the Constitutional Law in 1982 that the Republic of Turkey is such a state in which the rule of law exists. Although it was stated in the Constitutional Law in 1982 that Turkish Republic is under the rule of law, it could be analyzed via this thesis whether the principle as the rule of law can be sustained with the available legal regulations and practices assessing its own degree, and more specifically by means of "the transactions of administrative authority." Hence, first of all, the needs of the rule of law in special and general aspects, and in addition to this the features of the regulatory and individual transactions of the authority are tried to be explained. Again, in the same Costitutional Law of 1982, it was decided that all the transactions and actions of the administration would be under the checking power of judicial forces, but some executions and legal regulations in 1982's Constitutional Law along with some transactions of administation were taken into the space which is out of the checking control of judicial power. Those transactions which could be individual or regulatory in some aspects, being out of the the judical check, can be part of an important study, if the situation of them are analyzed under the rule that all of the transactions and actions of administation should be under the check of judicial power on behalf of the rule of law, and if the degree of mutual compatibility between the rule of law and the situation of those transactions are explored. In this thesis, which follows those mentioned aims, the actions being out of the judicial check are analyzed one by one, and the need of the rule of law are tried to be clarified in this way, besides more specifically via analyzing the decisions of the Constitutional Court and Council of State, in which the trials upon the regulatory and individual actions are performed, and finally it was concluded that the legal fidelity and being subject to law by judicial check for transactions in principles are not pursued in those manners, widely stated as the main ground of the rule of law.
