Gelişen deniz teknolojisi ile birlikte deniz alanlarında daha derinleri keşfetmek
mümkün hâle gelmekte ve bu durum su altı kültürel mirasının gün geçtikçe daha
korunmasız hâle gelmesine sebep olmaktadır. Dolayısıyla su altı kültürel mirasının
evrensel düzeyde korunmasını sağlayacak nitelikteki hukuki enstrümanlara ihtiyaç
gündeme gelmektedir. Çalışma kapsamında bu amaca hizmet eden, 2001 tarihinde
kabul edilmiş olan UNESCO Konvansiyonu değerlendirilmektedir.
Çalışmanın birinci bölümünde, UNESCO Konvansiyonunun tarihsel gelişimi
incelendikten sonra Konvansiyonun amacı, hukuki mahiyeti, uygulama alanı,
Konvansiyonda değişiklik yapılması, Konvansiyona çekince koyma yasağı ile
Konvansiyon kapsamında uyuşmazlıkların çözümü irdelenmektedir. Bu bölümde son
olarak Konvansiyon ile UNCLOS' un ilişkisi ele alınmaktadır.
Çalışmanın ikinci bölümünde, UNESCO Konvansiyonunda ortaya konulan
koruma rejimi irdelenerek, Konvansiyonun su altı kültürel mirasının korunması için yer
verdiği temel prensipler çerçevesinde devletlere yüklediği yükümlülükler ve taraf
devletlerin farklı deniz alanlarındaki su altı kültürel mirasını koruma yetkisinin kapsamı
açıklanmaktadır.
Çalışmanın son bölümü olan üçüncü bölümünde ise, UNESCO Konvansiyonuna
taraf olmayan bazı devletlerin taraf olmaktan kaçınmasının sebeplerine değinildikten
sonra Türkiye'nin Konvansiyona taraf olmaması ve genel yaklaşımı ayrıntılı olarak
incelenmektedir.

With the advancing marine technology, it becomes possible to explore deeper in
the marine areas, which makes the underwater cultural heritage more and more
vulnerable. Therefore, there is a need for sufficient legal instruments to ensure the
universal protection of the underwater cultural heritage. In this study, The UNESCO
Convention, which was adopted in 2001, will be evaluated for this purpose.
In the first part of the study, after examining the historical development of the
UNESCO Convention, the purpose of the Convention, its legal nature, its application
area, the amendment of the Convention, the prohibition of making reservations to the
Convention and the resolution of disputes within the Convention are examined. In this
context, this section will be ended with the assessment of the relationship between the
Convention and UNCLOS.
In the second part of the study, the protection regime laid down in the UNESCO
Convention is examined and the obligations imposed on the states within the framework
of the fundamental principles of the Convention for the protection of underwater
cultural heritage and the scope of the authority of the State Parties to protect underwater
cultural heritage in the different marine areas are explained.
In the third section, which is the last chapter of the study, after addressing the
cause of the hesitation to become a party of some of the non-party states, Turkey's
general approach to the Convention and its non-party to the Convention situation will be
scrutinized in detail. |
