6100 sayılı Hukuk Muhakemeleri Kanunu iddia ve savunmanın genişletilmesi ve değiştirilmesi yasağını düzenlemiştir. Davanın taraflarının iddia ve savunmaya ilişkin unsurları hangi aşamaya kadar davaya sunabilecekleri, dosyaya sunmuş oldukları unsurları sonradan değiştirme veya genişletmeye yönelik taleplerinin değerlendirilmesi esasları iddia ve savunmanın genişletilmesi ve değiştirilmesi yasağı ile ilgilidir. Ayrıca bu yasağın istisnasını oluşturan durumlar da 6100 sayılı Hukuk Muhakemeleri Kanunu ile düzenlenmiştir. Medeni yargılama hukuku bakımından sahip olduğu önem ve medeni yargılama hukukuna hakim ilkeler ile yakın ilişkisi nedeniyle iddia ve savunmanın genişletilmesi ve değiştirilmesi yasağının mevzuat, doktrin ve içtihatlar açısından değerlendirilmesi önem arz etmektedir.
The law number 6100 of Civil Procedure Code regulates the restriction of extention and modification of claim and defence. To the extent that the parties to the case can present the elements of the claim and defence to the case, the basis for assessing their demands for the subsequent modification or extention of the elements they have submitted to the file is related to the restriction of extention and modification of claim and defence. In addition the exceptions to this prohibition are regulated by the law number 6100 of Civil Procedure Code. Due to its importance in terms of civil trial law and its close relationship with the principles prevailing in civil trial law, it is important to evaluate the restriction of extention and modification of claim and defence in terms of legislation, doctrine and jurisprudence.
