Çalışmanın amacı; yaş tayini ve tashihi istenen olguların genel içindeki oranını, olay özelliklerini, işleyen prosedürün biçimini, hangi olaylarda hangi kurumlardan yaş tayini istendiğini ve yaş tayini istenen kurumların uyguladığı tıbbi metotları saptayarak Türkiye'nin yaş tayini ve tashihi konusundaki genel resmini, İstanbul uygulaması örneğinde ortaya koymaktır. Veriler; İstanbul Bakırköy Adliyesi'nde yaş tayini ve tashihine ilişkin dava dosyaları ile Adli Tıp Kurumu 2. İhtisas Kurulu'nun yaş tayinine ilişkin raporları üzerinden toplanmıştır. Veriler arasındaki ilişkiler istatistiksel olarak Ki–kare testi ile araştırılmış; p≤0,05 değerleri anlamlı kabul edilmiştir. Ceza davalarında yaş tayini genellikle cinsel istismar mağdurlarında, hukuk davalarında ise tashih gerekçesiyle yapılmıştır. Her iki dava türünde de belirgin biçimde yaş büyütme talebinin ön planda olduğu ve büyütme talebi olan davalarda yaş büyütme kararı verilme oranının yüksek olduğu izlenmiştir. Sadece mahkeme kararlarının değil, bilirkişi raporlarının da kararlarda olduğu gibi istemlerle paralel sonuçlar içerdiği gözlenmiştir. Son yıllarda ülkemizde artan sığınmacı sayısıyla birlikte gelecek dönemlerde ülkemize yerleşmek isteyecek sığınmacı çocukların yaşlarının tayinine yönelik işlemlerin artması beklenebilir.
The aim of this study is, using the example of İstanbul, to show the general picture of age determination and modification in Turkey stating the medical methods applied by the associations, which associations are applied to demand the age determination, at which cases the age determination is demanded, what kind of a procedure is in use, the features of the cases and ratio of the cases where age determination and age modifications are demanded in general. Data are collected from the case files at İstanbul Bakırköy Courthouse with regards to the age determination and age modification and reports from 2. Specialized Board of Forensic Science Association. The relations between the data was researched using x-square test and the value accepted is p≤0,05. Age determination is made for the victims of sexual abuse at Criminal Cases and it has been made for age modification at Civil Suits. It has been observed that the demand for age increasing was outstanding at both kind of cases and that the ratio of the decision given to increase of age was high. It has been observed that the outcomes were parallel not only at the Courthouse verdicts but also at the decisions of the experts' reports. In the last years as the number of refugees are increasing in our country, it may be expected that the processes of age determinatin can increase for the refugee kids who will want to settle down in our country.
