Öncelikle uyusturucu ve uyarıcı maddeler hakkında genel bir bilgi verilip eroinkaçakçılıgının ortaya çıkıs tarihçesi incelenerek, Türkiye'de eroin kaçakçılıgının ortaya çıkısıve eroin kaçakçılıgının ne boyutlarda oldugu, dünyadaki ve Türkiye'deki eroin maddesikaçakçılıgı güzergahları, rotaları ve eroin maddesi kaçakçılıgının akıs yönü, uyusturucumadde kaçakçılıgı yapan örgütlerin yapısı hakkında genel bir bilgilendirme yapılmıstır.Türkiye'de eroin kaçakçılıgı ile ilgili mevzuatı sekillendiren milletlerarası sözlesmeler veTürk Ceza Kanunun ilgili maddeleri ile örgütün hukuki unsurları incelenmistir.Bu çalısmada, 2004-2006 yılları arasında stanbul Emniyet Müdürlügü NarkotikSuçlarla Mücadele Sube Müdürlügünce düzenlenip Besiktas Agır Ceza Mahkemesinegönderilen konusu eroin olan 99 dosya ve 644'ü erkek 11'i bayan 655 süpheliye ait sabıkakayıtları, birinci ve ikinci dereceye kadar akrabalık iliskileri, uyrukları, dogum tarihleri,devamlı ikametgah adresleri, is yeri adresleri, meslekleri, medeni durumları, evli ise çocuksayısı, gelir durumları, tahsil durumları gibi bilgiler toplanıp incelenerek, örgüt faaliyetiçerçevesinde eroin imal ve ticareti suçunu isleyen süpheliler ve bu süphelilerden olusanörgütlerin karakteristik özellikleri ve çesitli yönlerden belirgin ortak özellikler tasıyıptasımadıkları hakkında degerlendirilme yapılmıstır.Genel olarak ifade edilecek olursa incelenen dosyalar kapsamında haklarında örgütfaaliyeti çerçevesinde islenen eroin maddesi imal ve ticareti suçlarına muhalefetten islemyapılan sahısların dogum yerlerinin genellikle Türkiye ve sırasıyla Van, Hakkari ve stanbulolan 31-45 yas aralıgında evli erkekler oldugu, ikametgahlarının büyük ölçüde stanbuloldugu, % 58'nin is yeri adresinin olmadıgı, dosyaların büyük çogunlugunda uyusturucu ilealakalı bir suçtan islem yapılmıs en az bir örgüt üyesinin bulundugu, en çok eroinyakalamasının kıs mevsiminde gerçeklestigi, dosyalar kapsamında ortalama 7 sahsa islemyapıldıgı ve yakalanan eroin miktarının dosya basına daralı 81,9 kg oldugu görülmüstür.
By studying the history of the rising of heroin smuggling after giving first of all ageneral information about the narcotic drugs and exciting substances, a general information isgiven about the rise of the heroin smuggling and what is the sizes of the heroin smuggling inTurkey, the itineraries, the routes of the heroin substance in the world and in Turkey, the flowdirection of the smuggling of the heroin substance, the structure of the organizations dealingwith the heroin smuggling. The international agreements forming the related legislation ofheroin smuggling in turkey and the related articles of the Turkish Penal Code and the legalelements of the organization have been studied.In this study, an evaluation has been made about 99 files of which their issue washeroin, sent to the high criminal Court after being arranged by the Directorate of Departmentof Fight against the narcotic crimes of Istanbul Directorate of Security between years 2004-2006 and the criminal records concerning 655 doubtful persons of whom 644 was male and11 was female, their connections of relativity of first and second degree, their nationalities,their birthdays, their permanent domicile addresses, their office addresses, their professions,their marital statutes, their number of children if they are married, their income situations,their educational situations being collected and studied, the doubtful persons acting the crimeof heroin production and commerce within the frame of the activity of the organization andthe characteristic features of these organizations formed by these doubtful persons andwhether they carry distinct common features from different direction or not.If it is expressed in general, it is seen that the birth places of the person that operationhas been made for acting against the crimes related to the production and commerce of theheroin substance within the activity of organization within the context of the files studied, isTurkey and then Van, Hakkari and Istanbul and that they are married men between 31-45years old, that their domicile was mainly in Istanbul, that 58% of them have no office address,that in many of the files there is at least one member of organization about whom operationhas been made about a crime related to the narcotic, that the most captures of heroin havebeen realized during the winter season, that operation has been made to average 7 personswithin the files and that the quantity of heroin per file is 81,9 kg with the weight of thecontainer included.
