Ülke ekonomisinin önemli aktörlerinden biri olan inşaat sektörü, gerek doğrudan; gerekse diğer sektörlerle arasındaki ilişki gereği dolaylı olarak, üretim ve istihdamı önemli ölçüde etkilemektedir. Ülke ekonomisinde bu denli büyük paya sahip olan bu sektörde, zaman içerisinde bir takım bazı değişim ve gelişmelerin yaşanılması ise kaçınılmaz bir gerçektir. Sektörde yaşanan bu değişim ve gelişmeler, yeni problem ve uyuşmazlıkları da beraberinde getirmiş olup; bu uyuşmazlıkların çözümü adına taraflar arasındaki ilişkileri düzenleyen daha kapsamlı inşaat sözleşmelerine ihtiyaç duyulmuştur. Anahtar teslimi inşaat sözleşmesi de bu ihtiyaçları karşılamak adına ortaya çıkmış olan bir inşaat sözleşmesi türüdür. İnşaatın meydana getirilip, işsahibine teslim edilmesi karşılığında, işsahibinin de yükleniciye sabit (götürü) bedel ödediği inşaat sözleşmesinin bir türü olarak sistemimizde kendisine yer bulan anahtar teslimi inşaat sözleşmesi bu çalışmada belirli yönleriyle incelenecektir. Construction sector, one of the major sectors of the national economy, both directly and indirectly affects dramatically the production and employment. Since the sector has significant effect on national economy, it is inevitable for some changes and developments. These changes and developments has brought along the problems and disputes. There has been a need for comprehensive construction contracts to regulate relations between the parties. Turnkey construction contracts are developed to meet these needs. In this study, turnkey construction contract a type of construction contract that the employer pays fixed fees to contractor on condition that the construction is completed and handed over to employer, will be analyzed.
