Tarihi dokuların bir parçası olan kültür varlığı yapılar zaman içinde kültürel değişimler ve hızlı yapılaşmanın etkisiyle günde güne yok alma tehdidi altındadır. Bu değişim sürecinde kültür varlığı yapıların özgün niteliklerini yitirmeden korunması ve gelecek kuşaklara aktarımı büyük önem teşkil etmektedir. Yapılan bu çalışma ile, kültür varlığı yapıların koruma faaliyetlerine yön veren yasal düzenlemeler ve kullanıcı müdahaleleri doğrultusunda meydana gelen değişimleri ele alınmıştır. Tez çalışması beş bölümden oluşmaktadır. 1. Bölümde; çalışmanın araştırma konusu belirtilerek amacı, kapsamı ve çalışma yöntemleri belirtilmiştir. 2. Bölümde; mimari koruma kavramı ve tarihsel gelişim süreci içinde Avrupa'da gelişme gösteren koruma fikirlerinin geçerliliği evrensel bildirilerle biçimlenmiş kuramların etkisi açıklanmıştır. Bu doğrultuda ülkemizde koruma yasalarının getirdiği gelişme ve değişimler açıklanmıştır. 3. Bölümde; tarihi yapıların kent içindeki yeri, konumu ve değerlerinin belirlenerek tespit ve tescil süreçleri ele alınmıştır. Bu yapıların sahip olduğu koruma değerleri, grup kararları doğrultusunda alınacak yasal izinler, ilke kararlarıyla yapıların müdahale biçimleri belirlenmiş ve müdahale sınırları anlatılmıştır. İlke kararları kapsamında uygulamalara yön veren kurumların yetki vedenetim dağılımları belirtilmiştir. 4.Bölümde; kültür varlığı yapıların koruma uygulamalarının değerlendirilmesinde çalışma alanı olarak seçilen Kuzguncuk semtinin yapısı, yerleşim düzeni ve koruma alanındaki yasal düzenlemeleri anlatılmıştır. Ele alınan kültür varlığı yapıların onarım uygulamalarında meydana gelen değişimleri, korumadan sorumlu kurumlardan alınan izinler ve kullanıcı müdahaleleri kapsamında ele alınmış, hazırlanan tablolar ile mevcut durum değerlendirmesi yapılmıştır. Bu değerlendirmelere göre inceleme alanında karşılaşılan sorunlar saptanarak, gerçekleştirilen müdahalelerin yasal düzenlemeler ve Boğaziçi alanındaki yetki ile denetimlerin korumada ne derece etkili olduğu açıklanmıştır. 5.Bölümde; yapılan inceleme, tespit ve değerlendirmeler doğrultusunda kültür varlığı yapıların koruma uygulamalarında ortaya çıkan sorunlara çözüm olabilecek yasal süreç ve teknik konular hakkında öneriler getirilerek, sağlıklı koruma politikalarının sürdürülmesinin önemi vurgulanmıştır.
Cultural asset constructions, which are a part of historical texture, are under the threat of destruction from day to day due to cultural changes and rapid housing. In this process of change, it is very important to protect cultural assets structures without losing their original characteristics and transfer them to future generations. This study discusses legal arrangements that govern the protection activities of cultural assets structures and their changes in the direction of user interventions. The thesis study consists of five parts. Chapter 1; describes the aim of the study is specified and the purpose, scope and methods of the study are. Chapter 2; explains the concept of architectural protection, the validity of protection approaches that developed in Europe within the historical development process and the effects of theories shaped by universal declarations are explained. In this direction, the developments and changes brought about by the protection laws in our country are described. In Chapter 3; the processes for assessment and registration of the place, the location and the value of the historical structures are handled. The protection values that these structures have, the legal permissions to be taken in line with the group decisions, the types of interventions through principles decisions and the limits of intervention are explained. The powers and controls distribution of the institutions guiding the applications within the scope of the principle decisions are stated. Chapter 4; describes the structure, settlement layout and legal arrangements in the protection area of Kuzguncuk neighborhood selected as the study area in the evaluation of the practices for protection of cultural asset structures. The changes in the restoration applications of the cultural assets structures at hand are analyzed in the context of the permits taken from the institutions responsible for protection and user interventions and the current situation is assessed with the tables prepared. According to these assessments, the problems encountered in the field of study are identified and it is explained to what extent the interventions made, the legal arrangements and the authority and control in the Bosphorus area are effective in protection. In line with the investigations, determinations and evaluations made, Chapter 5 brings suggestions about the legal process and technical issues that could be a solution to the problems arising in the practices for protection of cultural assets structures and emphasize the importance of maintaining healthy protection policies.
