Adli Tıp Kurumu Fizik İhtisas Dairesi Adli Belge İnceleme Şubesine gelen ve müzekkere ile iade edilen dosyaların incelenmesi" konulu tez çalışmamızın amacı, yazılı belge incelemelerinde zaman kaybına neden olan ve yargılama sürecini uzatan eksiklikler ve yapılan hataların tespiti ve çözüm önerileri getirilmesidir.Bu amaçla, "Adli belge hakkında temel bilgiler ve belge incelemesi yapan kurumlar" ve "Yazılı Belge İnceleme çeşitleri ve yöntemleri" ana başlıkları altında tez çalışması konuları, genel bilgiler başlığı altında incelenmiş, Adli Tıp Kurumu Fizik İhtisas Dairesi Adli Belge İnceleme Şubesince düzenlenen raporların 2006-2009 yılları arası ciltleri içerisinde eksiklikler nedeniyle müzekkere ile iade edilenlerinin miktar ve nedenlerinin tespiti için konu ile ilgili araştırma yapılmış, elde edilen bulgular, genel bilgiler ışığında değerlendirilerek tartışılmış ve ulaşılan sonuç ve öneriler açıklanmıştır.Yapılan çalışma, yazılı belge incelemeleri ile ilgili sorunların varlığını doğrulamaktadır. Ülkemizde belge incelemesi konusunda müzekkere yazılarak evrakın sonuçlandırılmadan iade edilmesinin önüne geçilebilmesi veya en azından bu sayının azaltılmasının temini için gerek adli makamlara açısından gerekse bilirkişiler açısından yol göstermesi için mukayese yazı veya imza alma, inceleme konusu ve mukayese belgelerin muhafaza ve gönderilmesi prosedürlerinin belirlenerek mukayese yazı formu örneklerinin oluşturulması gerektiği sonucuna varılmıştır.
The aim of our thesis:?Evaluation of Cases Referred to the Council of Forensic Medicine Physics Specialization Department by the Courts and Remanded to the Courts by the Council of Forensic Medicine with a Write of Query about the Case? is to determine the mistakes&deficiencies which causes delays in document examination, prolongs judgment process and to suggest solutions to these problems.For this purpose, thesis topics: ?Basics about Forensic Documents and Institutions Making Document Examinations? and ?Types&Methods of Document Examination? have been evaluated under the title of `General Information?. Among all cases of the Council of Forensic Medicine Physics Specialization Department, cases between 2006-2009 remanded to the courts by the Council of Forensic Medicine with a writ of query about the case(mostly due to deficiencies in the case records) have been evaluated to determine the quantity and reason of remands. The findings have been discussed in the light of general information about the topic; results and suggestions have been explained.This study has confirmed the problems about document examinations. As a result, in order to be able to prevent the remands of the cases without answering the questions of the courts or at least in order to be able to decrease the quantity of such remands, both for legal units and for experts, the need of constituting exemplar forms to determine dictated writing and questioned document procedures has been concluded.
