Tezin amacı, Amerikan İdare Hukukunun temel kavramlarından biri olan regülasyonun esas ve yöntemini karşılaştırmalı bir şekilde incelemektir. Bu tür bir araştırmayı yapabilmek için, devletin regülasyon faaliyetini neden ve nasıl yaptığının sorgulanması gereklidir. Bu kapsamda, regülasyonun ekonomik ve yasal temelleri kapsamındaki tarihsel gelişimi ortaya konmuş ve böylelikle deregülasyon, yani regülasyonsuzlaştırma hareketinin altında yatan hukuki, teknik ve ideolojik değişimlerin açıklanması da daha kolay bir hale gelmiştir. Nihayet, çalışma, regülasyon ve deregülasyonun sonuçlarını, belirli sektörler bakımından ayrı ayrı ele almaktadır.
The purpose of the thesis is to examine, on a comparative basis, the substance and the procedure of regulatory process, which is the main focus of American Administrative Law. In order to make such an inquiry, it explores the answer to the conventional question: Why and how do the government regulate? Hence, it briefly reveals the history of regulation in the context of economic and legal grounds. This makes it easier to explain the statutory, technological, and ideological changes driving the movement towards deregulation. Finally, employing a pragmatic industry-by-industry approach, it identifies the consequences of regulation and deregulation in particular economic sectors.
