ÖZETTezin konusu; ?Aile ve Ailenin Korunması? dır. Tez, giriş ve sonuç bölümleridışında üç bölümden oluşmaktadır.Birinci bölümde; aile ve aileye ilişkin temel ilkeler ana hatlarıylaincelenmiştir. Aile kavramı, aile tipleri, ailenin önemi ve aile ile hukuk ilişkisi elealınmıştır.kinci bölümde; Medeni Kanunumuzdaki evlilik birliği kavramı ve evlilikbirliğinin korunması amacıyla alınan önlemlere değinilmiştir.Üçüncü ve son bölümde ise; aile içindeki şiddetin önlenmesi amacıyla kabuledilen 4320 sayılı Ailenin Korunmasına Dair Kanun çerçevesinde alınabilecekönlemler ile Medeni Kanunumuzun genel hükümleri arasındaki ilişki açıklanmıştır.Çalışmamızın genelinde; ailenin korunması amacıyla, genel hükümler ile4320 sayılı Ailenin Korunması Kanunu çerçevesinde, hakimin ailenin iç işleyişinemüdahale ederek alabileceği önlemlere yer verilmiştir.165
ABSTRACTThe topic of the thesis is ?The Family and Family Protection?. The thesisconcists of three basic parts in addition to introduction and conclusion parts.In the first part, the family and the basic principles related with the familya reinvestigated in the main lines. The family concept, family types, the importance offamily and the relation of family and law have been taken into consideration.In the second part, the conjugal community item in the civil code and theprecautions taken to protect the conjugal community are explained.In the third part, the precautions taken in the light of the Law to Protect theFamily numbered 4320 which was accepted to prevent the violence in the family andthe relation between the general judgments of the civil code have been clarified.In the general case of our work, the precautions in order to protect the familywhich are general and also could be taken by the judge in use of the Law to Protectthe Family numbered 4320 by intervening the internal process of the family, areincluded.166
