Teknolojik gelişmelerin toplum hayatını şekillendirdiği günümüzde, insanlararasındaki ilişkileri düzenleyen hukuk kuralları da toplumsal ihtiyaçlara bağlı olarakdeğişmektedir. Bu süreçte, bilişim alanındaki gelişmelerde büyük bir hızla sürmekteve bilişim suçlarının işlenebilme olanakları da artmaktadır. Bu gelişmelerin gerisindekalmak istemeyen hukuk sistemleri de yeni düzenlemelerle bu süreçteki yerlerinialmaktadır.Bu çalışmamızda, her geçen gün yeni hukuki ihlallerin ortaya çıktığı bilişimsistemlerine yönelik olarak, 1 Haziran 2005 tarihinde yürürlüğe girmiş bulunan 5237sayılı Türk Ceza Kanununun getirmiş olduğu düzenlemeler incelenmiştir.Çalışmamızda bilişim sistemine girme, sistemi engelleme ve bozma suçlarının yanısıra, verileri yok etme ve değiştirme suçları ile bilişim sistemleri aracılığıyla işlenensuçlara da, konunun daha iyi anlaşılabilmesi için, yer verilmiştir. Bu çerçevedekonuyla ilgili teknik kavramlar, tarihi gelişim ve Yargıtay kararlarına da yer verilmişve diğer ülkelerin hukuk sistemlerindeki düzenlemelere de değinilmiştir.
In the present day where the technologic developments shape the public life,the legal principles that arrange the affairs of the people vary according to the publicdemands.In this process, also the developments at the information field go onrapidly and the possibility of commit of information crimes increase.The law systemswhich do not choose to stay at the back of these developments, take their placeswith the new arrangements in this process.In our work, the arrangements of Law no 5237 Turkish Criminal Code that hasbeen in force on June 1st 2005, are examined orientated to the information systemsthat the new legal prejudice occur day by day. In our work, entrance to theinformation system, together with blocking and deletion of the system, and alsodestroying the data and changing the crimes with the crimes that are committed bymeans of information systems are taken place for the subject to be understoodeasily.In this context, the technic concepts concerned with the subject, historicaldevelopment and the decisions of court of appeal are taken place and also thearrangements to the law systems of the other countries are mentioned.
