Bu çalışmanın amacı, olağanüstü hal döneminde yürütme organına tanınan geniş yetkilerin, anayasal sınırların dışına çıkılması sonucu insan haklarından olan masumiyet ilkesine etkisi incelenmiştir. 1982 Anayasası'nın olağanüstü hal dönemlerinde yürütme organına tanımış olduğu yasa gücünde Kanun Hükmünde Kararname çıkarma yetkisinin, anayasal sınırların aşılması sonucu insan haklarına nasıl etki ettiği örnek olaylarla açıklanmıştır. Olağanüstü hal dönemlerinde, anayasada teminat altına alınmış olan temel hak ve özgürlüklerin sınırlandırılmasında ve durdurulmasında, yürütme organına tanınan yetkilerin kullanılması sırasında uyulması gereken temel ilkeler ve bu ilkelerin sınırına değinilmiştir. Hukuk devleti olmanın doğal sonucu olarak adil yargılanma hakkı ve bu hakkın bir unsuru olan masumiyet ilkesinin ihlali sonucu nasıl bir durumun ortaya çıktığı örnek olaylar üzerinden değerlendirilmiştir. İnsan haklarının, olağanüstü hal rejimlerinde bile uyulması gereken asgari ilkelerinin olduğu, bu ilkelerin amacının insanın doğuştan sahip olduğu, insanı diğer canlılardan ayıran ve ona özgü değeri olan insan onurunu korumak olduğu vurgulanmıştır.
The aim of this study was to examine the effect of the broad powers granted to the executive branch during the state of emergency on the principle of human rights innocence as a result of being out of constitutional limits. Case studies have shown how the power to issue decrees with the force of law granted to the executive branch by the constitution of 1982 during the periods of emergency had an effect on human rights as a result of exceeding constitutional limits. In the period of emergency, the basic principles that must be followed during the exercise of the powers granted to the executive branch and the limits of these principles were addressed in limiting and stopping the fundamental rights and freedoms guaranteed in the Constitution. The right to a fair trial as a natural result of being a state of law and what kind of situation arose as a result of the violation of the principle of innocence, which is an element of this right, has been evaluated through case studies. It has been emphasized that human rights have minimum principles to be followed even in emergency regimes, and that the purpose of these principles is to protect human dignity, which is inherent in Man, which distinguishes man from other living beings and which has unique value to him..
